In certain geographical areas, Socios Services Limited (C91496) or its affiliates (“Socios” or “We”, “Us” or “Our”) make available Our free loyalty programme to reward the users (“You”, “Your”, “User”) for the SSU You freely gathered while supporting their favourite team on the Socios App (“Fan Rewards”). If You are within those geographical areas, the program may be displayed to You. By using the Socios App (as defined in the App Terms) when the program is displayed, You agree to participate in Fan Rewards in accordance with the following terms and conditions (“T&C”) as part of Your use of the Socios App, which terms and conditions are incorporated herein by reference (the “App Terms”) (also found at https://www.socios.com/socios-com-application-terms-of-use/).
1. Description, Eligibility & Access
NO PURCHASE IS NECESSARY TO USE FAN REWARDS. Fan Rewards enables You to redeem Rewards associated with the team for which You hold Fan Tokens (the “Reward”) in exchange of an amount of SSU Tokens (as defined in the App Terms). We may to our sole discretion offer multiple categories of Rewards: merchandise, experiences, Collectible Token and vouchers (respectively the “Merch Rewards”, the “Experience Rewards”, the “Collectible Token Rewards” and the “Voucher Rewards” and together the “RewardsCategories”). Fan Rewards is accessible to Users on the Socios App. You need to hold a specific amount of the Fan Token (as defined in the App Terms) of a specific team to access and select a Reward associated with that team. We display the amount of Fan Tokens required to access any specific Reward directly on the Socios App. We may, in Our sole discretion, alter, limit, or modify at any time the content, the functioning and the availability of Fan Rewards, notably but not exclusively the required amount of Fan Token, the amount of SSU Tokens required to redeem Rewards and the Rewards themselves, the taking down of Fan Rewards or any other feature of the Socios App interacting with Fan Rewards.
2. Selecting and Redeeming a Reward
Rewards can only be redeemed on the Socios App according to the following steps and no Reward can be accessed or redeemed from any of our establishment, offices and other types of physical presence anywhere in the world.
In Fan Rewards You can select a Rewards Category and browse Rewards which are made available to You in Our entire discretion and may be modified by Us from time to time.
While selecting Your Reward You undertake to read, understand the characteristic (including but not limited to day of the event, material, size, shape, colour, stadium, seat location), the amount of SSU Tokens and the personal requirements associated with each particular Rewards as described on the respective page.
You can select up to one (1) Reward in one (1) Rewards Category (“Select a Reward” or “Selected Reward”) each time You redeem Reward. We reserve the right to determine and change the maximum number of units per Reward You may select to redeem from time to time.
Rewards are provided to You in person according to the identity associated to Your account. Also, You may not transfer or sell Rewards to any third-party.
In order to award the Reward to You, We may request to collect some of Your (personal) data in order for instance to comply with country specific laws and regulations or third-party, rules and/or requirements. When requested by Us from time to time in Fan Rewards, You represent and warrant to provide Us with Your accurate and up to date (personal) data. You may not use personal data of a third person in Fan Rewards. Shall You elect not to provide the (personal) data as requested from Us for the redemption of the Rewards, then the part of Fan Rewards requiring these (personal) data may be limitedly available to You and this may among others prevent You from redeeming your Rewards. In turn shall You elect to provide the (personal) data, these the (personal) data will be collected in line with the applicable data protection law and in accordance with Our applicable Privacy Policy.
Throughout Fan Rewards, We undertake to inform You with these T&C and in the Socios App and You acknowledge and agree that Your confirmation to redeem a Reward is final and You may not elect to withdraw your redemption. In addition, after your confirmation, exchange/replacement and/or (part/full) refund in SSU or with any money is not possible. Further, We undertake to inform You with these T&C and in the Socios App and You acknowledge and agree that We will not charge your SSU Token back or provide you with any monetary equivalent, once you have confirmed Your Selected Reward. By agreeing to these T&C and confirming Your Selected Rewards, You consent to redeem the Reward You have selected and waive any rights to introduce any kind of inquiry or claim arising out of or indirectly related to Your Reward either directly against Socios or before any third-party public or private body.
Fan Reward does not require any fee or payment from Your end and the Selected Reward are redeemed exclusively in exchange of Your loyalty point, namely SSU Token, which bear no monetary or financial value as laid down in the App Terms. Once You have confirmed, Your Selected Reward will only be redeemed if Your SSU Token balance is equal or superior to the required amount displayed for the Selected Reward. Based on the foregoing, the required amount of SSU Tokens for the respective Rewards will be deducted from Your SSU Token balance. If Your balance for SSU Tokens is inferior to the amount required for the Rewards You seek to redeem, then confirmation of the Rewards will not be possible. A summary of Your redeemed Rewards will be available via the transaction history.
3. Shipping and Delivery of Rewards
3.1. Shipping of Merch Rewards
We bear any reasonable cost incurred with the standard shipment of Your redeemed Merch Rewards to the address You have indicated in Fan Rewards. However, We do not bear costs of custom or any similar charges that might be imposed to Your Rewards. You acknowledge and agree that the Merch Rewards You have redeemed will be sent to You on Our behalf with the support of a third-party. We do not accept any responsibility and exclude any liability for any loss You incur in the event of the loss, partial damage to or complete loss of the Rewards, delay in reception of the Rewards due to the third-party in charge of the delivery. You acknowledge and agree that if You communicate an address or any other information particularly for the delivery that is inaccurate, not up to date or inaccessible, the Reward You have redeemed can be lost for which We assume no responsibility or liability and that we will not send any substitute of the redeemed Rewards in place of the lost Rewards.
We do not ship or deliver Rewards in the following jurisdictions: Burma, Central African Republic, Comoros, Cuba, Equatorial Guinea, Falklands, Guinea Bissau, Iran, Johnston Island, Kiribati, Korea North, Mayotte Island, Myanmar, Nauru, Niue, Saint Pierre Et Miquelon, Sao Tome & Principe, Sierra Leone, Solomon Islands, Somalia, St. Helena, Sudan, Syria, Tajikistan, Tokelau Islands, Republic of Turkmenistan, Tuvalu, Wake Islands, Republic of Yemen.
You acknowledge and agree that We shall not communicate any delivery date or tracking data to You regarding the Rewards You have redeemed. Delivery times and dates for Merch Rewards varies on the delivery area. We do not warrant to deliver Merch Rewards to You in a specific time period. If any delivery date is communicated to You, You agree that these are only tentative and based on information we obtained from third parties and We do not assume any responsibility or liability for not delivering the Rewards according on such tentative delivery date.
3.2. Shipping and Allowance of Experience Rewards
You understand, acknowledge and accept that in the event that the Experience Rewards involve any ancillary expenses, including but not limited to, travelling and accommodation costs, it is hereby being outlined that We shall not cover any such costs, such ancillary costs hereby being explicitly excluded from forming part of the Experience Rewards or from being provided by Us. We will issue Your Experience Rewards and send it to You on the basis of the (personal) information You have submitted in Fan Rewards or at a later stage to redeem Your Experience Rewards. You represent and warrant and shall be responsible to provide Us with the complete, accurate and up to date information as is reasonably required for the accurate and timely issuance and sending of the Experience Reward to You. You are obliged to inform Us of any change to your personal information any change that may affect the effecting of the Experience Rewards no later than one (1) week prior to the event with official documents evidencing these changes. You represent and warrant to cooperate with Us or Our third-party Experience Rewards providers on providing complete, accurate and up to date information as may be requested from time to time in order to provide You with the Experience Rewards.
We provide the Experience Rewards to You via email and when applicable in box office collection at the related event.
In particular with regards to the Experience Rewards You acknowledge and agree with the following limitation of liability:
- You shall visit an event at Your own risk. We assume no responsibility or liability for any bodily and/or property damage You may personally incur or cause to any third party while going to the Experience Reward or while taking part to the Experience Reward.
- You shall be solely responsible for abiding by the rules, regulations, policies and a code of conduct established by the local authorities and/or third party Experience Reward providers and/or event organizers. We shall not be held liable for any direct or indirect damages You may incur if You are denied admission, access to or You are expelled of an Experience Reward, in particular but not only when due to:
- Your wilful misconduct, and/or;
- Your lack of compliance with laws and regulations applicable in while going to or where the Experience Reward takes place (including but not limited to Covid regulations and stadium rules), and/or with the terms and conditions of third-party providers collaborating with Us in Experience Rewards
- And in these events, we may at Our sole discretion take the measure we deem appropriate to avoid such situation in the future. This includes but is not limited to: Your suspension from Fan Rewards or from the Socios App.
- You shall be solely responsible for obtaining the correct dates, starting times of events, and pick-up details for the Experience Rewards You redeemed.
- You shall not be provided with a replacement Experience Reward in the event that the admission ticket is lost, stolen or damaged.
- We assume no responsibility or liability for not issuing the Experience Rewards if You do not provide Us with the required (personal) information that are complete, accurate and up to date at least 1 weeks before the occurrence of the Experience Rewards, and/or You are in breach of these T&C.
- We shall not be responsible or liable if You are unable to access the event and/or if the event is cancelled or rescheduled due to reason beyond Our control such as a decision of a third party Experience Reward provider, adverse weather conditions, strikes, civil disturbances or a decision made by competent authorities and/or the organizers etc.
You hereby acknowledge and agree that the Experience Rewards shall be delivered in collaboration with third party Rewards providers and You hereby agree to be bound by any terms and conditions imposed by such third parties and the respective covid-related rules applicable in the stadium or arena.
3.3. Airdropping of Collectibles Token
Collectible Token may be allocated on your Socios Account once Your redeemed Collectible Token Reward has been confirmed or at a later period to our sole discretion. Further, the App Terms (in particular but not only section 7.9.) apply to Your use of Collectible Token.
4. Representation and Warranties
You represent, undertake and warrant that:
- You use the Socios App in compliance with these T&C applied in accordance with the App Terms.
- You comply with third party terms and conditions, as applicable from time to time in the execution of these T&C.
- You comply with the covid-related rules and restriction in place wherever the Reward is provided throughout the Experience Rewards.
- the Fan Reward has not been developed to meet Your individual requirements, and that it is therefore Your responsibility to ensure that the Rewards as described in the Fan Rewards meet Your requirements.
- You use Fan Rewards for domestic and private use and not use the Fan Rewards for any commercial, business or resale purposes, and we have no liability to You for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We reserve the right to refuse to award Rewards to anyone who in Our sole opinion is in breach of these T&C, the App Terms and/or any applicable law.
5. Indemnity and Liability
By using Fan Rewards You agree to indemnify, defend and hold Us Our affiliates, directors, officer, employees and agents as well as others associated with the provision of Fan Rewards harmless from and against any and all third-party claims, all liability arising from Your use (or misuse) of Fan Rewards or in any way arising from Fan Rewards, the awarding and use or misuse of or possession of the Rewards, including liability for personal injury, except where limited or prohibited by law, or Your breach of the T&Cs.
Except as otherwise set out in these T&C, and to the fullest extent permitted by Applicable Law, We shall not be held responsible or liable to You in respect of:
- any failure to carry out, or any delay in carrying out, any matter in respect of Your Fan Rewards caused by any circumstances outside Our reasonable control;
- any unauthorised use of Your Fan Rewards by You or a third party;
- the exercise of any discretion by Us as a consequence of any restrictions required by applicable law and/or applicable sport regulation;
- any products and/or services provided by any third party, including a third-party Rewards providers, in connection with the Fan Rewards, including but not limited to the delivery, standard, quality or otherwise of any Rewards and/or the failure of such a third party to make a specific Reward available; and/or
- any indirect, special or consequential loss or damage, or any loss of profit or revenue, loss of use or enjoyment, loss of business or contracts, or loss of opportunity, whether in contract, tort or otherwise.
Nothing in these T&C or the App Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
For the sake of clarity, as a result of an pandemic outbreak or the spread of a disease (eg. Covid-19), We or Our third party Rewards providers may be required by applicable law and/or any applicable sport regulation, to cancel alter or substitute an Experience Rewards at Our or Our third party Rewards providers sole discretion. We shall not have any responsibility or liability to You in respect of any such Experience Rewards for which We or Our third party Rewards providers are unable to offer You the related service and/or experience such as right to attend matches, meet and greet experiences and/or the exercise of any discretion by third-party rewards providers in respect of the allowance of the Experience Rewards.
All products are subject to availability when You place Your order. We do not warrant to provide Rewards for all the sport team we partner with and remain entirely free to choose which Rewards we make available. We do not take responsibility for Rewards that are displayed available but not anymore in stock. Images of Rewards and their respective packaging on the online services are examples only and may not be identical to the Rewards or packaging You receive. Differences may be due Your device’s display of colours or any other factor.
Notwithstanding the present T&C, certain Rewards may not be available for all orders at all locations. If for any reason the selected Reward has become unavailable, We reserve the right to award You an equivalent Rewards as the one You sought to redeem and You waive Your right to obtain a Reward similar to the one You have ordered.
We provide the Socios App and the Fan Rewards without any warranties. We do not warrant that Fan Rewards may include inaccuracies or errors or free of viruses or other harmful components. The App may link to or allow You to use third-party websites, downloadable materials, content, social networks, or other digital services (together, “third party services”). These third parties may have their separate terms and conditions or privacy policies that You should review and understand before using them. We do not endorse and are not associated with these third-party services. WE HAVE NO RESPONSIBILITY FOR ANY LOSS OR DAMAGES ARISING FROM OR RELATED TO THESE THIRD PARTY SERVICES.
We reserve all legal rights to recover damages or other compensation under the T&C or as allowed by law. We shall be is entitled to take any action we consider appropriate, including removing or suspending Your account and freezing Your SSU Token accrued if we detect any suspicious activity concerning Your account including but not limited to:
- engaging in illegal or fraudulent activities;
- supplying or attempting to supply false or misleading information, or making a misrepresentation to Us or Our third party Rewards providers; or
- use SSU that have been illicitly or fraudulently obtained; or
- reselling the Rewards for a commercial purpose; or
- excessive earning (via fraud or other means).

This T&C are entering into force as soon as they are available to the public on the Socios App or via our Website (as defined in the App Terms). The contractual relationship between You and Socios is governed by the T&C and the App Terms.
These T&C are governed by the laws of Malta and any disputes arising out of or in connection with these T&C and/or the Leaderboard and/or the Prize shall be referred to the exclusive jurisdiction of the Maltese courts and tribunals.
